The Registrar of the office of the Honourable Judge Murphy has advised the attorneys of the HSAG that Judge Murphy will give judgement on 30 August 2017 in the following two matters:<\/span><\/p>\n

1. Mr Helgard Hancke’s application to intervene in support of Mr Nic Georgiou and others’ leave to appeal against the order which Judge Murphy granted in favour of the HSAG; and<\/span><\/p>\n

2. Mr Nic Georgiou’s application for leave to appeal against the two orders in favour of the HSAG, namely that the former HSAG Applicants’ withdrawal of the Application to Certify the Class Action was unlawful and the Reinstatement of the New HSAG Applicants was valid and binding.<\/span><\/p>\n

The meeting of the HSAG’s legal team with the Case Manager in the Johannesburg High Court, Judge Sharise Weiner, went well.<\/span><\/p>\n

1. The HSAG requested the Case Manager for an order to compel the Respondents to provide all the contact details of the HS Investors to the HSAG.<\/span><\/p>\n

Judge Weiner ordered the Respondents to comply with Judge Spilg’s order within 10 court days by supplying to the HSAG Attorneys all contact details, including cellphone numbers and email addresses, in both electronic and hard copy format.<\/span><\/p>\n

2. Judge Weiner was also requested to compel the Respondents to file their opposing papers in the setting aside of the S155 Scheme of Arrangement (SoA) to expedite the proceedings.<\/span><\/p>\n

Judge Weiner advised, once we have received the Order of Judge Ismail, the HSAG may approach the Case Manager again regarding the further conduct of the case.<\/span><\/p>\n

3. Judge Weiner was also requested to consider allowing the Supplementary Founding Affidavit by the HSAG, setting out further grounds why the Scheme of Arrangement should be set aside, to which Orthotouch objected.<\/span><\/p>\n

Judge Weiner ordered that the Supplementary Affidavit be accepted.<\/span><\/p>\n

Nic Georgiou is accused of trying to scuttle a potential class action suit against him.<\/span><\/p>\n

The gloves have come off in the application for leave to appeal by property magnate Nic Georgiou against a judgment that he illegally tried to scuttle a potential class action suit against him.<\/span><\/p>\n

In a strongly worded affidavit Jacques Theron, the attorney representing the Highveld Syndication Action Group (HSAG), responded to allegations made by former HSAG member Helgard Hancke in an application to become an intervening party in Georgiou\u2019s\u00a0application for leave to appeal<\/a>\u00a0against a\u00a0judgment in May<\/a>.<\/span><\/p>\n

MR HELGARD HANCKES\u2019S APPLICATION FOR LEAVE TO INTERVENE<\/strong><\/span><\/p>\n

Mr Hancke served and filed two Applications (in both the High Courts of Pretoria and Johannesburg) for leave to intervene in the current Applications for Leave to Appeal.<\/span><\/p>\n

Hancke\u2019s Application in the High Court of Pretoria was served the day immediately preceding the hearing on 2 August 2017. Given the irrelevancy of Hancke\u2019s averments, the HSAG decided not to ask for a postponement to file opposing papers (thereby effectively causing a further delay), but instead argued the Application for Leave to Appeal in the Pretoria High Court. (Murphy J reserved judgment in respect of the relief to appeal the Application, as well as Hancke\u2019s Application to Intervene).<\/span><\/p>\n

Hancke also served a similar Application for leave to Intervene in the High Court of Johannesburg, after which the HSAG served and filed an Opposing Affidavit in opposition to the Application for Leave to Intervene.<\/span><\/p>\n
