HSAG NEWS FLASH<\/strong><\/p>\n

After the opposition had served their Notices of Appeals on the HSAG’s lawyers, the HSAG lawyers addressed a letter to the Registrar of the Supreme Court of Appeals (SCA) in October 2017 requesting that the Johannesburg and Pretoria appeal cases be heard simultaneously<\/strong> and on an expedited<\/strong> basis<\/strong>.<\/p>\n

However, the Registrar indicated that the above request can only be considered after the Court record has been submitted to the Court. The Court record was finally served on the HSAG’s lawyers on 2 February 2018 and submitted to the SCA on 5 February 2018.<\/p>\n

The HSAG’s lawyers immediately sent a letter to Orthotouch and Mr Georgiou confirming that the Court records were filed out of time and that the Appeals had therefore expired. Both attorneys denied same.<\/p>\n

The HSAG Attorneys addressed a further letter to the Registrar of the SCA on 12 February 2018, asking for urgent directives to be issued in respect of the hearing of pending Appeals.<\/p>\n

Since the court records have now been filed, the Registrar requested that a letter be sent directly to the Judge President of the SCA.<\/p>\n

We confirm that the lawyers of the HSAG sent a letter to the Judge President on 22 February 2018 requesting that the Johannesburg and Pretoria appeal cases be heard simultaneously and on an expedited basis.<\/p>\n

Nadat die teenkant hul Kennisgewings van App\u00e8lle op die HSAG se prokureurs beteken het, het die HSAG se prokureurs in Oktober 2017 \u2018n skrywe aan die Registrateur van die Hoogste Hof van App\u00e8l (HHA) gerig waarin versoek was dat die Johannesburg en Pretoria app\u00e8l aangeleenthede van die HSAG gelyktydig<\/strong> en op \u2018n bespoedigde<\/strong> basis aangehoor word.<\/p>\n

Die Registrateur het egter aangedui dat bogenoemde versoek slegs oorweeg kan word nadat die Hofrekord by die Hof ingedien is. Die Hofrekord is uiteindelik op 2 Februarie 2018 op die HSAG se prokureurs beteken en op 5 Februarie 2018 by die HHA ingedien.<\/p>\n

Die HSAG se prokureurs het onmiddelik daarna \u2018n skrywe aan Orthotouch en Mnr Georgiou gestuur waarin bevestig was dat die Hofrekords buitenstyd ingedien was en dat die App\u00e8lle derhalwe verval het. Beide prokureurs het dit ontken.<\/p>\n

Die HSAG se Prokureurs het op 12 Februarie 2018 \u2019n verdere skrywe aan die Registrateur van die HHA geaddresseer, met die versoek dat dringende aanwysings uitgereik moet word ten opsigte van die aanhoor van hangende App\u00e8lle.<\/p>\n

Aangesien die Hofrekords nou ingedien was, het die Registrateur versoek dat \u2018n skrywe direk aan die Regter-president van die HHA gestuur word.<\/p>\n

Ons bevestig dat die prokureurs van die HSAG op 22 Februarie 2018 \u2018n skrywe aan die Regter-president gestuur het waarin ons versoek het dat die Johannesburg en Pretoria app\u00e8l aangeleenthede van die HSAG gelyktydig en op \u2018n bespoedigde basis aangehoor word.<\/p>\n
