The HSAG served and filed its Heads of Argument on Friday, 23 March 2018, in accordance with the directives issued by the Supreme Court of Appeal.<\/p>\n

13 March 2018<\/strong><\/p>\n

ANOTHER VICTORY FOR THE HSAG WITH APPEAL DATE RETAINED!<\/strong><\/p>\n

Since the President of the Supreme Court of Appeal (SCA) issued a directive for the expedited date of hearing the appeal, Mr Nic Georgiou and others once again tried to delay the Court process, by informing the Registrar that their advocates were not available on 8 May 2018.<\/p>\n

Orthotouch’s attorneys requested that the date be postponed to another date.<\/p>\n

Without first obtaining such permission from the SCA Registrar, Orthotouch\u2019s legal representatives arranged a new date with the HSAG\u2019s councel and then consulted with the Registrar without the HSAG attorneys present, to which our legal team objected.<\/p>\n

Both Orthotouch and Mr Georgiou\u2019s advocates are new on the matters and new counsel could easily be briefed for the hearing date without much inconvenience.<\/p>\n

The President of the SCA issued a further directive:<\/p>\n

    \n
  1. The Appellants must serve and file their Heads of Argument on or before 16 March 2018;<\/li>\n
  2. The HSAG must serve and file its Heads of Argument on or before 23 March 2018;<\/li>\n
  3. The President of the SCA did not entertain the Appellants request to postpone the Appeal date, thus the Appeals are still to be heard on 8 May 2018<\/strong>.<\/li>\n<\/ol>\n

    NOG \u2018N OORWINNING VIR DIE HSAG TEN AANSIEN VAN DIE APP\u00c8LDATUM!<\/strong><\/p>\n

    Sedert die President van die Hoogste Hof van App\u00e8l (HHA) \u2018n aanwysing uitgereik het met betrekking tot die aanhoor van die App\u00e8lle op \u2018n bespoedigde basis, het Mnr Georgiou en ander weereens probeer om die Hofproses uit te rek deur die Registrateur van die HHA in kennis te stel dat hul Advokate nie op 8 Mei 2018 beskikbaar is nie.<\/p>\n

    Orthotouch se prokureurs het derhalwe versoek dat die datum uitgestel moet word.<\/p>\n

    Sonder om toestemming van die Registrateur van die HHA te verkry, het Orthotouch se prokureurs die HSAG se regsverteenwoordigers genader ten einde \u2018n nuwe App\u00e8ldatum te kry en het ook die Registrateur besoek, sonder dat die HSAG prokureurs teenwoordig was, waarop ons beswaar gemaak het.<\/p>\n

    Beide Orthotouch en Mnr Georgiou se advokate was nuut aangestel en kon hulle sonder moeite en enige ontwrigting nuwe advokate aanstel.<\/p>\n

    Die President van die HHA het gevolglik nuwe aanwysings uitgereik:<\/p>\n

      \n
    1. Die App\u00e8llante moet hul Hoofde van Betoog beteken en liasseer voor of op 16 Maart 2018;<\/li>\n
    2. Die HSAG moet hul Hoofde van Betoog beteken en liasseer voor of op 23 Maart 2018;<\/li>\n
    3. Die President van die HHA het nie gehoor gegee aan Mnr Georgiou se versoek om die App\u00e8ldatum te skuif nie en word die App\u00e8lle steeds op 8 Mei 2018<\/strong> aangehoor.<\/li>\n<\/ol>\n

      The following directives were issued by the President of the Supreme Court of Appeal (SCA) on 2 March 2018 with regards to the simultaneous hearing of the Johannesburg and Pretoria Appeals, as well as the request that we can approach the Court on an expedited basis:<\/p>\n

        \n
      1. and Mr Georgiou must serve and file their Heads of Argument on or before 12 March 2018;<\/li>\n
      2. The HSAG legal team must then serve and file Heads of Argument on or before 19 March 2018;<\/li>\n
      3. Both the Johannesburg and Pretoria Appeals will be heard on 8 May 2018<\/strong>.<\/li>\n<\/ol>\n

        The HSAG management and legal team are very positive about the latest developments!<\/p>\n

        Die volgende aanwysings is op 2 Maart 2018 deur die President van die Hoogste Hof van App\u00e8l (HHA) uitgereik met betrekking tot die gelyktydige aanhoor van die Johannesburg en Pretoria App\u00e8lle asook die versoek dat ons die Hof op \u2018n bespoedigde basis kan nader:<\/p>\n

        1. Orthotouch en Mnr Georgiou moet voor of op 12 Maart 2018 hul Hoofde van betoog beteken en liasseer;<\/li>\n
        2. \u00a0Die HSAG-regsspan moet voor of op 19 Maart 2018 Hoofde van Betoog beteken en liasseer;<\/li>\n
